Contributor Terms
Effective Date: August 28, 2026
These Contributor Terms govern the submission, distribution, licensing, and management of photographs, video, and other visual content submitted to KULTURE Images by photographers, videographers, and other approved contributors.
By submitting content to KULTURE Images, the contributor agrees to these Contributor Terms.
1. Contributor Relationship
KULTURE Images operates as an independent image licensing and distribution agency representing visual content submitted by approved contributors.
Contributors remain independent creators and are not employees, partners, joint venturers, or agents of KULTURE Images.
Nothing in these Contributor Terms creates an employment relationship between KULTURE Images and a contributor.
2. Copyright and Ownership
Contributors retain copyright and ownership of their submitted content.
Submission of content to KULTURE Images does not transfer copyright or ownership to KULTURE Images.
The contributor grants KULTURE Images the authority necessary to display, market, promote, distribute, and license approved content on the contributor's behalf in accordance with these Contributor Terms.
3. Licensing Authority
The contributor authorizes KULTURE Images to offer approved content for licensing to editorial, commercial, creative, institutional, and other authorized buyers.
KULTURE Images may establish licensing categories, usage options, pricing structures, territories, durations, distribution limits, and other licensing parameters applicable to content offered through the platform.
Licenses issued by KULTURE Images do not transfer copyright ownership to buyers.
4. Contributor Revenue
Unless otherwise agreed in writing, licensing revenue received from contributor content will be divided as follows:
70% to the contributor.
30% to KULTURE Images.
The contributor's share is calculated from licensing revenue actually received by KULTURE Images, excluding refunds, chargebacks, payment-processing fees, taxes collected on behalf of governmental authorities, and other transaction-specific deductions where applicable.
5. Payments
Contributor earnings will be tracked based on completed licensing transactions involving the contributor's content.
Payments will be issued according to the payment schedule and payment method established by KULTURE Images.
KULTURE Images may withhold amounts associated with refunds, chargebacks, disputed transactions, suspected fraud, unauthorized transactions, or other adjustments relating to a license.
Contributors are responsible for providing accurate payment and tax information when required.
6. Content Submission
Contributors may submit photographs, video, and other visual content that meets KULTURE Images' editorial, technical, legal, and quality standards.
KULTURE Images is not required to accept, publish, distribute, or continue representing every image or other item submitted.
KULTURE Images may select, reject, organize, categorize, edit metadata for, remove, or discontinue distribution of content at its discretion.
7. Contributor Representations
By submitting content, the contributor represents that:
The contributor owns the content or otherwise possesses sufficient rights and authority to submit it for licensing.
The contributor has authority to authorize KULTURE Images to distribute and license the content.
The content does not knowingly infringe the copyright or intellectual property rights of another photographer, videographer, creator, or rights holder.
Information supplied about the content, including captions, dates, locations, identities, events, releases, restrictions, and other metadata, is accurate to the best of the contributor's knowledge.
The contributor has disclosed any known restrictions affecting the licensing or use of the content.
8. Editorial Content
Contributors may submit editorial content depicting recognizable individuals, trademarks, copyrighted works, locations, events, or other subjects for which model, property, or other releases may not exist.
Such content may be designated for editorial use only.
Contributors must not represent content as commercially cleared unless the necessary releases or permissions have been obtained.
9. Model and Property Releases
When a model release, property release, or other permission exists, the contributor must accurately disclose its availability.
KULTURE Images may request copies of applicable releases or permissions.
The existence of a release does not guarantee that KULTURE Images will make content available for every possible commercial use.
10. Credentials, Access, and Restrictions
Contributors are responsible for complying with credential agreements, venue rules, event restrictions, contractual limitations, embargoes, and other conditions governing the creation or distribution of their content.
Contributors must disclose any restriction that may affect KULTURE Images' ability to license submitted content.
Content created under an agreement prohibiting commercial licensing, third-party distribution, resale, or other uses may not be submitted for uses prohibited by that agreement.
11. Metadata and Accuracy
Contributors should provide accurate captions, keywords, dates, locations, names, event information, and other relevant metadata when submitting content.
KULTURE Images may modify, standardize, supplement, or correct metadata for search, licensing, editorial, administrative, or distribution purposes.
Material factual inaccuracies should be reported to KULTURE Images as soon as reasonably possible.
12. Promotion of Contributor Content
The contributor authorizes KULTURE Images to display submitted content, including watermarked or preview versions, for purposes of operating, marketing, advertising, and promoting KULTURE Images and the contributor's available licensing portfolio.
Such promotional display does not transfer ownership of the content.
13. Non-Exclusivity
Unless a separate written agreement states otherwise, representation by KULTURE Images is non-exclusive.
Contributors may license or distribute their content through other channels, provided doing so does not conflict with licenses already issued through KULTURE Images or any separate exclusivity arrangement applicable to specific content.
14. Existing Licenses
Contributors remain responsible for honoring licenses or agreements entered into before submitting content to KULTURE Images.
Contributors must disclose any existing license, exclusivity arrangement, embargo, restriction, or contractual obligation that could affect KULTURE Images' ability to license particular content.
15. Removal of Content
Contributors may request removal of content from future licensing availability.
Removal does not terminate or modify licenses that were validly issued before the content was removed.
KULTURE Images may retain transaction records, licensing records, metadata, and other information necessary to document licenses previously issued.
16. Unauthorized Use and Enforcement
KULTURE Images may take reasonable action to address suspected unauthorized use of content represented through the agency.
Where appropriate, this may include contacting users, requesting licensing fees, issuing infringement notices, working with service providers, or referring matters for legal enforcement.
Nothing in these Contributor Terms transfers the contributor's copyright to KULTURE Images.
17. Artificial Intelligence and Emerging Uses
KULTURE Images will not knowingly authorize contributor content for artificial intelligence training, machine-learning datasets, facial-recognition systems, generative models, NFTs, blockchain-based assets, or similar uses unless such use is expressly permitted under an applicable licensing arrangement and authorized as required.
18. Taxes
Contributors are responsible for their own federal, state, local, and other tax obligations arising from payments received through KULTURE Images.
KULTURE Images may request tax documentation and issue tax reporting forms when required by law.
19. Suspension or Termination
KULTURE Images may suspend or terminate a contributor relationship or remove content if a contributor violates these Contributor Terms, submits content without sufficient rights, repeatedly provides inaccurate information, engages in fraudulent or unlawful conduct, or otherwise creates material legal or business risk for KULTURE Images.
A contributor may discontinue future participation by providing notice to KULTURE Images.
Termination does not affect licenses validly issued before termination.
20. Indemnification
The contributor agrees to be responsible for claims, losses, liabilities, damages, or expenses arising from the contributor's material breach of these Contributor Terms, lack of rights to submitted content, materially inaccurate representations regarding submitted content, or failure to disclose known licensing restrictions.
21. Limitation of Liability
To the maximum extent permitted by applicable law, KULTURE Images will not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in the contributor program.
Nothing in these Contributor Terms limits rights or liabilities that cannot legally be limited or excluded.
22. Changes to Contributor Terms
KULTURE Images may update these Contributor Terms as its services, licensing practices, contributor program, or legal requirements evolve.
Material changes may be communicated to active contributors through the website, contributor account, or contact information provided by the contributor.
23. Governing Law
These Contributor Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles.
Any dispute arising from these Contributor Terms or participation in the KULTURE Images contributor program will be subject to the jurisdiction of the appropriate courts located in Maryland, unless otherwise required by applicable law.
