Licensing Terms
Effective Date: August 28, 2026
These Licensing Terms govern all licenses issued by KULTURE Images for photographs, video, and other visual content made available through the KULTURE Images website.
By purchasing a license, the buyer agrees to these Licensing Terms and the specific usage parameters selected and displayed at checkout.
License Grant
KULTURE Images grants the buyer a limited, non-exclusive, non-transferable license to use the selected content solely for the usage specified at the time of purchase.
The license does not transfer copyright or ownership of the content.
All rights not expressly granted remain with the applicable photographer, videographer, creator, or other rights holder.
Rights-Managed Licensing
Unless otherwise identified, content available through KULTURE Images is licensed on a rights-managed basis.
The scope and price of a license may be determined by factors including:
Usage type.
Industry or project type.
Placement.
Media or platform.
Image size.
Distribution.
Territory.
Duration.
Circulation.
Audience.
Impressions.
Number of copies.
Other applicable usage parameters.
The buyer may use the content only within the parameters specified in the completed licensing transaction.
Additional and Extended Use
A license applies only to the use purchased.
Reuse of content for another publication, campaign, advertisement, product, project, platform, territory, distribution channel, placement, or other use not included in the original transaction requires an additional license.
Modification of a project or expansion of its distribution does not automatically expand the original license.
Editorial Use
Content designated for editorial use may be used for legitimate news, reporting, commentary, documentary, educational, cultural, historical, or other appropriate editorial purposes within the scope of the purchased license.
Editorial content may depict recognizable individuals, trademarks, copyrighted works, locations, events, artwork, or other subjects for which commercial releases may not exist.
Editorial content may not be used in a manner that falsely suggests endorsement, sponsorship, or commercial association.
Commercial Use
Commercial, advertising, promotional, merchandise, packaging, and similar uses require the appropriate license and may also require model releases, property releases, trademark clearance, or other third-party permissions.
The availability of content for licensing does not represent that every image is cleared for every possible commercial use.
The buyer is responsible for obtaining additional permissions when required unless KULTURE Images expressly confirms in writing that the necessary clearance has been obtained.
Commercial use of content without applicable releases or third-party clearances may require additional permissions from the persons or rights holders depicted and may be subject to review by KULTURE Images before licensing.
Third-Party Rights, Releases & Clearances
Unless expressly stated in the asset information or license confirmation, KULTURE Images does not represent or warrant that a model release, property release, trademark clearance, publicity or privacy consent, venue permission, or other third-party authorization has been obtained for persons, property, brands, designs, artwork, or other protected material depicted in the licensed content.
A license issued by KULTURE Images grants only those rights in the content controlled by the copyright owner or authorized licensor.
The buyer is responsible for determining whether additional permissions, releases, consents, or clearances are required for the buyer’s intended use and for obtaining any such permissions before use.
The absence of a release does not grant or imply any right to use a person’s name, image, likeness, property, trademark, design, artwork, or other protected material for advertising, endorsement, merchandising, promotional, or other commercial purposes.
Where KULTURE Images expressly identifies a release or clearance as available, any permitted use remains subject to the scope and limitations of that release or clearance.
Restrictions
Unless expressly authorized by the purchased license, licensed content may not be:
Resold, sublicensed, redistributed, shared, or transferred as a standalone file.
Used beyond the scope of the purchased license.
Included in templates, asset libraries, image collections, databases, or other products that allow third parties to extract or reuse the content.
Used as a trademark, service mark, logo, or other source identifier.
Used in a defamatory, unlawful, deceptive, pornographic, or otherwise illegal manner.
Used in a way that falsely represents a depicted person as endorsing a product, service, organization, political position, or other subject.
Submitted to or used for artificial intelligence training, machine-learning datasets, facial-recognition systems, generative models, or similar technologies without express written authorization.
Used to create NFTs or other blockchain-based digital assets without express written authorization.
Used to remove, conceal, alter, or misrepresent copyright information, attribution, metadata, content credentials, watermarks, or other rights-management information.
Alterations and Editing
Reasonable cropping, resizing, color correction, text placement, and other modifications necessary for the licensed use are permitted provided the modifications do not create a defamatory, deceptive, unlawful, or materially misleading representation.
Alterations do not create ownership rights in the underlying licensed content.
Credit and Attribution
Where a credit is required by the applicable license or customary for the intended editorial use, the credit should identify the photographer or creator and KULTURE Images as provided with the licensed asset or licensing record.
Removal of embedded copyright or rights-management information is prohibited.
Licensee Responsibility
The buyer is responsible for ensuring that the selected license accurately reflects the intended use.
The buyer is also responsible for maintaining records of the license and ensuring that employees, contractors, designers, agencies, publishers, printers, or other parties working on the licensed project comply with the license.
Providing a licensed file to a service provider solely for production of the authorized use does not grant that service provider independent rights to use the content.
Unauthorized or Excess Use
Use of content without a valid license or beyond the scope of a purchased license constitutes unauthorized use.
Unauthorized or excess use may result in additional licensing fees and may constitute copyright infringement and/or breach of contract.
KULTURE Images and the applicable rights holder reserve all rights and remedies available under law.
License Records
The licensing information associated with the completed transaction constitutes the record of the rights granted to the buyer.
Buyers should retain copies of invoices, receipts, license confirmations, and other transaction records.
Refunds and Cancellations
Because licenses provide immediate rights to digital content, completed licenses and downloaded files are generally non-refundable.
Claims involving defective files, incorrect delivery, duplicate transactions, or material technical errors may be reviewed by KULTURE Images.
Termination of License
KULTURE Images may terminate a license if the buyer materially violates these Licensing Terms or the specific restrictions of the purchased license.
Upon termination, the buyer must discontinue any future use of the content and remove the content from uses that are no longer authorized, subject to applicable law and any written instructions provided by KULTURE Images.
Governing Law
These Licensing Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles.
Any dispute arising from a KULTURE Images license will be subject to the jurisdiction of the appropriate courts located in Maryland, unless otherwise required by applicable law.
